Terms of sale

1. Purpose
These general terms and conditions of sale (GTC) govern the contractual relationship between the company Mimoze
S.A.S., registered with the Trade and Companies Register under the number 983 398 793, whose head office is
located at 9 rue des Colonnes 65002 Paris, hereinafter referred to as "the Seller," and any natural or legal person
wishing to make a purchase, hereinafter referred to as "the Buyer," via the website mimoze.fr, hereinafter referred to
as "the Website."
2. Acceptance of Terms
Placing an order on the Website implies unreserved acceptance of these GTC. These terms may be modified at any time by
the Seller, and the conditions applicable will be those in effect on the date of the order.
3. Products
The Products offered for sale are those described on the Website on the day of consultation by the Buyer, subject to
stock availability. The Seller strives to present the characteristics of the products as accurately as possible;
however, minor differences may exist between the Products and their representation on the website.
Given the artisanal nature of the production, each Product is unique, and slight variations in design, color, or other characteristics may exist between the Product shown and the Product delivered. By accepting these GTC, the Client acknowledges understanding the artisanal nature of the Products and waives any claim or complaint related to variations inherent to this artisanal nature.

4. Prices
The prices of the Products are indicated in euros (€) and include all applicable taxes (VAT), excluding shipping
costs. The Seller reserves the right to modify prices at any time, but products will be invoiced based on the rates in
effect at the time of order validation.
5. Order
The Buyer places an order on the Website. Any order implies acceptance of the prices and descriptions of the products
available for sale. The Seller confirms the acceptance of the order to the Buyer at the email address provided. The
Seller reserves the right to cancel an order for any reason, particularly due to stock depletion, even after sending
the Buyer the order confirmation email. The sale will only be concluded upon the Seller's confirmation of the order.
The Seller cannot be held responsible for the cancellation of an Order placed on the Website.
6. Payment Terms
Payment is made online by credit card through one of the secure systems offered on the Website: Shopify Payments,
PayPal, etc. Banking information is not retained by the Seller. The order can only be shipped after full payment is
received.
7. Delivery
The Products are delivered to the address indicated by the Buyer at the time of the order. The Seller undertakes to
ship the products within the timeframes indicated when the order is validated, subject to product availability.
Delivery times are indicative and may vary depending on the carriers. In the event of a delivery delay, the Buyer will
be informed by email. The delivery of the ordered items will take place no later than thirty (30) days from the order
date. Delivery costs are borne by the Buyer and are indicated before the order is validated.
8. Right of Withdrawal and Product Returns
In accordance with applicable law, the Buyer has a period of 14 days from receipt of the products to exercise their
right of withdrawal without providing reasons or incurring penalties, except for return costs, which are entirely the
responsibility of the Buyer. To exercise this right, the Buyer must notify their decision to withdraw by email to
mimoze@mimoze.fr. Upon receipt, the Seller will send a return voucher and the address for returning items within 5
days by email. Return costs remain the responsibility of the Buyer, as do the initial delivery costs. The Buyer has 5
days from the return voucher issuance to return the products. The Seller strongly recommends the Buyer ensure the
Products are returned by a method providing a certain date and to retain proof of return. Products must be returned in
their original complete condition along with the duly completed return voucher. Products not returned within this
period or returned incomplete, damaged, deteriorated, soiled, or in any other condition suggesting reasonable use or
wear will not be refunded or exchanged and will be returned to the Buyer.
The refund of the invoiced price of returned Products will be made using the payment method used for the order, no later than 14 days following receipt of the said Products. Pursuant to Article L.221-24 of the Consumer Code, the delivery fees paid by the Customer will not be refunded.
Additionally, in the case of a gift, the right of withdrawal remains exclusively for the Buyer and cannot be exercised by the gift recipient.
The refund of the invoiced price of returned Products will be made using the payment method used for the order, no later than 14 days following receipt of the said Products. Pursuant to Article L.221-24 of the Consumer Code, the delivery fees paid by the Customer will not be refunded.
Additionally, in the case of a gift, the right of withdrawal remains exclusively for the Buyer and cannot be exercised by the gift recipient.
9. Legal Warranty
All Products supplied by the Seller are covered by the legal warranty of conformity and the warranty against hidden
defects in accordance with legal provisions. In case of a defective or non-compliant Product, the Buyer must inform
the Seller as soon as possible, providing evidence (photos, detailed description of the defect, etc.).
10. Liability
The Seller cannot be held liable for indirect damages that may occur as a result of purchasing the Products. The
Seller's liability under the obligations of these GTC cannot be engaged in cases of force majeure as defined by French
case law.
11. Personal Data Protection
The information collected during the order is necessary for managing the transaction and shipping the products. In
accordance with the Data Protection Act, the Buyer has the right to access, rectify, and delete personal data
concerning them by sending a request to mimoze@mimoze.fr.
12. Intellectual Property
All elements of the Website, whether visual or audio, including the underlying technology, are protected by copyright,
trademarks, or patents. They are the exclusive property of the Seller.
13. Applicable Law and Disputes
These GTC are subject to French law. In case of a dispute, the Buyer agrees to contact the Seller's customer service
at mimoze@mimoze.fr to attempt to resolve any issue amicably. Failing an amicable solution, the dispute will be
submitted to the competent courts.
